Suid-Afrika – 26 Maart 2019 gaan ’n waterskeidingsaak wees waarin vasgestel gaan word of daar nog enigsins plek vir die grondwet en internasionale verdrae in die Republiek van Suid-Afrika se howe bestaan.  Dit gaan aandui of vergelding en onderdrukking van die Boerevolk so ’n prioriteit in Suid-Afrika geword het dat alle regspleging oorboord gegooi word.

Prof. Hercules Booysen, ’n internasionaal erkende akademikus en juris, beoog om op 26 Maart ’n aansoek namens mev. Riëtte Pretorius in Pretoria se Hooggeregshof te bring.  Sy vra die hof om haar grondwetlike en internasionaal-erkende regte te beskerm, naamlik die reg op assosiasie en beskerming van haar familie en gesin.  Haar versoek is dat haar familielede tydelik vrygelaat moet word.  Dit sluit in haar man, dr. Wilhelm Pretorius, haar skoonpa, dr. Lets Pretorius en haar swaer, dr. Johan Pretorius.

Hulle reg op vryheid is reeds sedert 2002, die jaar van hulle gevangeneming in verband met die Boeremagsaak, geskend.  Die tydelike vrylating word gevra, hangende die afhandeling van die klagte wat deur haar familielede by die Verenigde Nasies se Menseregte-komitee in 2018 ingedien is.  Die klagte kan tot vier jaar duur voordat dit afgehandel word.  Dit beteken dat haar familielede wat reeds nagenoeg 17 jaar onregmatig aangehou word, vir nog 4 jaar onregmatig aangehou moet word, voordat die VN se komitee beslis dat hulle vrygelaat moet word.  Volgens Pretorius kan die VN se komitee, weens die feite en regsgesag, tot geen ander beslissing kom nie.  In haar hofstukke voer sy drie punte aan om te wys dat hulle onregmatig aangehou word:

  • Vyf jaar ná hulle vonnis in Oktober 2013, kon hulle steeds nie daarin slaag om te appelleer nie. Hulle reg op appèl is dus onherroeplik geskend.  Volgens die grondwet en Internasionale Verdrag op Politieke en Siviele Regte, waarin Suid-Afrika ’n party is, skend dit die regmatigheid van die hele verhoor.
  • Die staat weier om die volledige en amptelike rekord en dokumentasie van die strafverhoor aan hulle te verskaf. Daarom het hulle nie die nodige dokumentasie om te kan appelleer nie.  Dit skend dus ook hulle grondwetlike- en internasionaal-erkende reg op appèl.
  • Hulle reg op ’n wettig-saamgestelde hof is geskend. Wetgewing bepaal dat assessore slegs dien tot en met skuldigbevinding.  In hulle strafsaak het die assessore gedien tot die einde van die vonnis en was die samestelling van die hof dus onwettig.  Hulle is daarom gevonnis deur ’n onwettige hof.

Boervin vra vir elkeen se ondersteuning en gebede in hierdie verband.  Dit kan die begin wees van die Boerevolk Politieke Gevangenes se vrylating asook ’n boodskap vir die staat dat daar gevolge is vir die onderdrukking van die Boerevolk.  Elkeen wat die hofsaak wil bywoon is welkom, aangesien dit ’n openbare verhoor is.

Media Release: Boeremag family member claims their release in court

Unlawful incarceration continues after 17 years

South Africa – On 26 March 2019 there will be a watershed court case, which will determine whether there is any space left in the South African courts for the constitution and international covenants.  It will show whether revenge on, and oppression of, the Boer people pertains such a priority in South Africa that it negates all justice.

Professor Hercules Booysen, an internationally renowned academic and jurist, intends to appear on behalf of Mrs Riëtte Pretorius in the Pretoria High Court.  She requests the court to protect her constitutional and international acknowledged right of association and protection of her family.  Her request is that her family should be temporarily released: it includes her husband, Dr Wilhelm Pretorius, her father-in-law, Dr Lets Pretorius and her brother-in-law, Dr. Johan Pretorius.

Their right to freedom has been infringed since 2002, the year of their arrest in connection with the Boeremag case.  The temporary release is being requested, pending the completion of the complaint, laid by her family members at the United Nation’s Human Rights Committee in 2018.  The complaint could take up to four years before being finalised.  This means that her family members, which are already being deprived of their freedom for 17 years, must endure another 4 years of infringement of their rights, before the UN Committee rules that they should be released.  Pretorius argues in her court papers that, due to the judicial foundation of their complaint, the UN Committee could not come to another conclusion.  She bases her application on three arguments regarding their unlawful incarceration:

  • Five years after their sentence, they could still not succeed to appeal. This has violated their right to appeal.  According to the Constitution and International Covenant on Political and Civil Rights, of which South Africa is a party, it also infringes their right to a fair trial.
  • The state refuses to present them with a complete record and documentation of the trial and deprive them of the necessary documents for appeal. This also infringes their constitutional and internationally protected right to appeal.
  • Their right to a lawful constituted court was infringed.  The law determines that assessors only serve until the verdict.  In their trial the assessors remained on the bench till the end of sentence, which manifest an unlawful court.  They were therefore sentenced by an unlawfully constituted court.

Boervin asks for everybody’s support and prayers for this case.  It could be the beginning of the release of the Boer Political prisoners and also send a message to the state of consequences about the oppression of the Boer People.  Anyone who wishes to attend the court case is welcome, since it is a public hearing.
